1. Agreement to These Terms

Welcome to FindClinica ("we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of FindClinica — our website, mobile applications, and desktop applications (together, the "Service"). By downloading, installing, creating an account, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Who May Use the Service

The Service is intended for licensed healthcare practitioners, clinics, and their authorised staff. By using the Service you confirm that:

  • You are at least 18 years old and legally able to enter into these Terms.
  • You hold any licence or registration required to practise in your jurisdiction.
  • Any information you provide during registration is accurate and kept up to date.

3. Your Account

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised access. We are not liable for loss arising from your failure to keep your credentials secure.

4. Subscriptions, Plans and Billing

FindClinica is offered on a Free plan and on paid Pro and Premium plans. Each plan's features, storage allowance, and connected-device limits are described on our pricing page and may be updated from time to time.

  • Billing cycle: Paid plans are billed monthly or yearly, in advance, according to the cycle you select at the time of purchase.
  • Currency: Customers in Pakistan are billed in PKR. International customers are billed in USD; the displayed USD figure is a conversion of the PKR price and may vary with exchange rates.
  • Price changes: We may change our prices. Any change takes effect from your next billing cycle, and we will give you reasonable notice beforehand.
  • Non-payment: If a subscription payment is not received, we may downgrade your account to the Free plan or suspend access to paid features until payment is made.

5. Refunds and Cancellation

We offer a full refund within 30 days of purchase, no questions asked. To request a refund, contact us using the details in section 13. You may cancel your subscription at any time; cancellation stops future billing and your paid features remain active until the end of the period you have already paid for. Beyond the 30-day window, payments are non-refundable except where required by law.

6. Your Data and Your Patients' Data

You retain ownership of all patient records, images, and other content you enter into the Service ("Your Data"). You grant us only the limited permission needed to store, process, back up, and sync Your Data so we can operate the Service for you.

You are the custodian of your patients' information and you are responsible for:

  • Obtaining any consent required before entering patient data into the Service.
  • Complying with the medical records, privacy, and data protection laws that apply to your practice.
  • The accuracy of the clinical records you create.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

7. Storage Limits and Backups

Each plan includes a storage allowance. If you exceed your allowance, uploads may be blocked until you free up space or upgrade your plan. While we take regular backups and apply reasonable safeguards, you remain responsible for keeping your own independent copies of clinical records where your professional or legal obligations require it.

8. Data Security

We take the security of your data very seriously and use industry-standard measures to protect it. However, no method of transmission over the Internet and no method of electronic storage is 100% secure. We therefore cannot guarantee the absolute security of your data.

8.1. Reporting Security Issues

If you become aware of any security vulnerability, or you suspect unauthorised access or a hacking attempt, you must promptly report it to us at findclinica@gmail.com.

8.2. No Liability for Third-Party Breaches

We are not liable for any loss or damage arising from third-party breaches or unauthorised access to your account, provided we have implemented reasonable security measures.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in breach of any applicable regulation.
  • Upload malicious code, or content you do not have the right to store or share.
  • Share a single-practice licence across unrelated clinics, or exceed your plan's device limits by circumventing technical restrictions.
  • Reverse engineer, decompile, resell, sublicense, or attempt to extract the source code of the Service.
  • Interfere with, overload, or attempt to gain unauthorised access to our systems or another user's account.

We may suspend or terminate accounts that breach this section.

10. Not a Medical Device or Clinical Advice

FindClinica is a practice management and record-keeping tool. It does not provide medical advice, diagnosis, or treatment recommendations, and it is not a substitute for professional clinical judgement. All clinical decisions remain solely the responsibility of the treating practitioner.

11. Service Availability and Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, add, or remove features, and we may schedule maintenance that temporarily interrupts access. Where a change materially reduces a paid feature you rely on, we will give reasonable notice.

12. Limitation of Liability

To the fullest extent permitted by law, FindClinica is provided "as is" and we are not liable for indirect, incidental, or consequential losses, including lost profits, lost patients, or loss of data arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, or if required by law. Following termination you may request an export of Your Data for a reasonable period, after which it may be permanently deleted in line with our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. Significant changes will be announced by posting the updated Terms on our website and revising the effective date above. Continued use of the Service after a change takes effect means you accept the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law principles.
